Effective from 16 September 2026
In short: we sell course packages. Buying one gives you a personal licence to the content and, optionally, the right to earn commission on genuine course sales you refer. Nothing is payable for recruitment alone, no income is guaranteed, and members must never claim otherwise. The detail below is what actually binds us both.
01Acceptance of these terms
These Terms & Conditions are a binding agreement between you and Nitesh Skill Hub Private Limited Company (“Nitesh Skill Hub”, “we”, “us”), a company incorporated in India with its registered office at .
They govern your use of this website, your purchase of any course package, your access to course content, and — if you choose to take part in it — your participation in our direct selling opportunity as a member. By creating an account, buying a package or using any part of the platform, you confirm that you have read, understood and accepted these terms.
If you do not accept them, do not register and do not purchase. Where these terms conflict with a statement made verbally by any member, distributor or third party, these terms prevail. No member is authorised to vary them on our behalf.
02Who may join
To register as a member you must:
- Be at least 18 years of age and competent to contract under the Indian Contract Act, 1872.
- Be a resident of India, or otherwise legally able to receive payments in India.
- Hold a valid PAN and a bank account in your own name.
- Provide accurate, current and complete information, and keep it updated.
One person, one account. Multiple accounts operated by the same individual — whether directly, through a relative, or through any arrangement designed to occupy extra positions in the genealogy — are prohibited. We may merge or terminate duplicate accounts and forfeit any income generated through them.
Employees, directors and their immediate family members may be restricted from holding member accounts where doing so would create a conflict of interest.
03Your account and its security
You are responsible for everything that happens under your account. Keep your login password and your separate transaction password confidential, and never share them — not with your sponsor, not with your upline, and not with anyone claiming to be from our support team. We will never ask you for either password.
Registration creates your account and verifies your email address. Access to the member dashboard, course content and the earning features opens only once a package purchase is confirmed. This is a deliberate condition of membership, not a technical limitation.
Tell us immediately if you suspect unauthorised access. We may suspend an account temporarily where we reasonably believe it has been compromised, and we log administrative access to member data for audit.
04Packages, pricing and payment
We offer a range of course packages. The packages available, what each one includes and its price are set out on our Plans page, and the price shown there at the time you buy is the price that applies. Each package is a one-time payment. Goods and Services Tax is charged in addition where applicable, and the tax treatment applied at checkout is shown before you pay.
Payment is collected through a third-party payment gateway. We do not see or store your card, UPI or net-banking credentials. Your purchase is confirmed only when we receive confirmation of capture from the gateway; a debit from your account without that confirmation is not a completed purchase, and is either settled or reversed automatically.
We may revise package prices, contents and inclusions. Changes apply to purchases made after the change and never retrospectively to what you have already bought.
05Your licence to the course content
Buying a package grants you a personal, non-exclusive, non-transferable, revocable licence to access the course content included in that package, for your own learning, for as long as the platform operates. It does not transfer ownership of anything.
You must not:
- Share, sell, sub-licence, rent or give away your account access.
- Download, screen-record, mirror or re-upload any video, document or template, except where a resource is explicitly marked as downloadable.
- Reproduce our content in your own training material, paid or free.
- Use automated tools to scrape, harvest or bulk-download content.
- Remove or obscure any watermark, copyright notice or attribution.
We monitor for concurrent access from implausible locations and for abnormal download patterns. Breach of this clause is grounds for immediate termination without refund, and we reserve our right to pursue damages.
06The direct selling opportunity
Membership includes the option — never the obligation — to earn by referring genuine course sales. You are an independent direct seller. You are not our employee, agent, partner or franchisee, no employment relationship arises, and you have no authority to bind us or to make representations on our behalf.
Two relationships are recorded and they are distinct. Your sponsor is the member who introduced you, and drives direct commission. Your placement is your position in the binary genealogy, and drives matching income. Where a requested placement position is already occupied, the system places you at the next available position on that side.
Every payable amount is tied to a completed course sale. No amount is payable for enrolment, for recruitment, for the act of introducing a person, or for any activity that is not a genuine sale of a course package. This platform is not a money circulation scheme, chit fund, or any scheme falling within the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, and it must never be presented as one.
Commission rates, the binary matching percentage, daily capping, carry-forward, rank targets and reward campaign terms are published in the member dashboard. We may revise them prospectively with notice; revisions do not affect commission already earned and credited.
07Member conduct — what you must not do
How members represent this business matters more than almost anything else in these terms. As a member, you must not:
- Promise, guarantee or imply any specific income, return, or "guaranteed" earnings to anyone, in any medium.
- Present the opportunity as an investment, a deposit scheme, a job, or a government-recognised programme.
- Publish screenshots of earnings, income proofs, or "lifestyle" claims that suggest typical results.
- Pressure anyone to buy a package they cannot afford, or offer to fund somebody's purchase to occupy a position.
- Create or fund accounts in other people's names.
- Use spam, bulk unsolicited messaging, misleading advertising, or paid ads that use our brand name without written permission.
- Make medical, legal, financial or employment claims about outcomes of our courses.
- Re-sell, discount or bundle our packages outside the platform.
- Misuse our trademarks, logo or copyrighted material, or set up websites, groups or pages that appear to be operated by us.
We take these seriously and we enforce them. Breach may result in withheld commission, suspension, or termination with forfeiture of unpaid balances, in addition to any legal remedy available to us. If you see a member making claims like these, please report it through the contact page.
08KYC, taxes and payouts
Earnings accrue to your wallet in the dashboard. Before your first payout you must complete KYC — PAN, a government photo identity document, and bank account details in your own name. Payouts are made only to a bank account matching the verified KYC name.
Tax is deducted at source at the rate prescribed under the Income Tax Act, 1961, and deposited against your PAN. If your PAN is not verified, deduction is made at the higher rate the Act requires. You are responsible for declaring this income and for your own GST registration and compliance where your turnover requires it.
Payouts are two-phase: you request, and we review and approve before payment. A transaction password challenge is required on every request. The payout cycle, the minimum payout amount and any administrative charge are published in your dashboard. We may withhold a payout where a purchase is disputed, a chargeback is pending, KYC is incomplete, or we are investigating a suspected breach of these terms.
Clawback. If a purchase that generated commission is refunded or reversed, the corresponding commission is reversed from the earning member’s wallet, and from a future payout where the wallet balance is insufficient.
09Suspension and termination
You may close your account at any time by writing to us. Closure does not entitle you to a refund of a package outside the Refund Policy, and unvested or disputed amounts are dealt with under that policy.
We may suspend or terminate an account, with notice where practicable and immediately where necessary, if we reasonably believe you have breached these terms, provided false information, engaged in fraud or manipulation of the genealogy, or acted in a way that harms other members or the company’s standing.
On termination your course access ends, your position in the genealogy is closed, and your downline is retained and re-parented under our standard placement rules. Any confirmed balance owed to you that is not subject to clawback or investigation remains payable, subject to KYC and tax deduction.
10Intellectual property
All content on this platform — course videos, documents, templates, text, graphics, the Nitesh Skill Hub name, logo and marks — belongs to us or to our licensors and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.
Members may use our approved marketing material as supplied, unchanged, solely to promote the packages. Any other use, including creating derivative promotional material using our brand, requires our prior written permission.
11Disclaimers and limitation of liability
The platform and its content are provided on an “as is” and “as available” basis. We work hard to keep it accurate and available, but we do not warrant that it will be uninterrupted, error-free, or that the content will produce any particular result for you. See our Disclaimer and Income Disclaimer.
To the fullest extent permitted by law, our total aggregate liability to you arising out of or in connection with your membership is limited to the amount you actually paid us for your package in the twelve months preceding the claim. We are not liable for indirect, incidental, special or consequential loss, or for loss of profits, anticipated savings, or business opportunity.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, or your rights as a consumer under the Consumer Protection Act, 2019.
12Indemnity
You agree to indemnify and hold us harmless against any claim, demand, loss, penalty or reasonable legal cost arising from your breach of these terms, your misuse of the platform, any representation you make about the company or the opportunity that is not authorised by us, or your violation of any law or the rights of a third party.
13Complaints and grievance redressal
Raise any complaint first through the contact page or, if you are a member, as a ticket from your dashboard. We acknowledge complaints within 48 hours.
If it is not resolved to your satisfaction, escalate it to our Grievance Officer, whose name and contact details are published on the contact page as required by Rule 5 of the Consumer Protection (Direct Selling) Rules, 2021. Grievances are resolved within 30 days of receipt. You retain your right to approach the National Consumer Helpline or the appropriate Consumer Commission at any time.
14Governing law, jurisdiction and changes
These terms are governed by the laws of India. Subject to the consumer forum rights you have under the Consumer Protection Act, 2019, the courts at CITY OF JURISDICTION have exclusive jurisdiction over any dispute arising from them.
We may amend these terms. Material changes are notified in the dashboard and by email at least 15 days before they take effect, and the effective date at the top of this page is updated. Continuing to use the platform after that date means you accept the revised terms.
If any provision is held unenforceable, the rest continues in force. Our failure to enforce a provision is not a waiver of it.
